It just keeps getting worse :(

OK, so as some of you know, a couple weeks ago i was rear ended in my baby (seems like a lot of us are getting in wrecks lately...) and the girl who did it claimed 100% responsibility http://www.chargerforums.com/forums/showthread.php?t=58639 , so fast forward to this afternoon and i get a call from my dads friend who owns the shop my cars at, and he tells me that he was just getting back from being out of town, and his second in command had left him a message on Sunday saying that they put my car on the frame laser they have and that the frame is damaged, but didn't say how bad or any details, but my dads friend is home sick so he wont be able to get to the shop for a day or 2 to see for himself,. so now the insurance guy has to go back out and they all have to check how bad it really is, and possibly declare it totaled. he said he would have a final word on everything for me on Friday. so basically this week has gone from the expected homecoming of my precious, to possibly the bringer of the grim reaper :cry:...god i just wanna die.

but now i have a question for you guys, if they declare it totaled, whats gonna happen? are they just gonna give me a check for the market value of the car, or are they gonna reimburse me for the entirety of what i spent on it? (I'm gonna demand that anyways, but I'm curious what would normally be done)

x2, same when you trade a car in, you won't get any more for aftermarket parts.

I work for one of the three major insurance companies....you better start taking some of your mods off. If you can, just a suggestion.

remember you guys, this is her insurance co. not mine, so it really dousnt matter what coverage there is or isnt, anyways i owe less than the cars worth, so im not worried about any gap or w/e, im just curious if thier gonna give me enough money to get the same car again without having to spend any more cash than i already have, or was planning on spending

The insurance company will try to lowball you. You do not have to take the first offer. Simply state that I cannot replace the car for that $ amount. See if you can bump the offer. Provide all documentation of any mods and current pricing from www.nadaguides.com and www.kbb.com and www.edmunds.com. Make sure you use the highest pricing. If you cannot bump the offer to your satisfaction.....it is off to the attorney's

cool, this is what i wanted to hear, and i already blue booked her, and the highest they gave was only like 4 grand less than sticker was :) I'm pretty stoked on that, but I'm gonna do my damned best to get a certain amount i have in my head for it

If they do total it, there is a guy on here selling his Super Bee, maybe have insurance company by it for ya?? Just a thought..
shh, Ive actually been looking at that for the last day or so, and even thought its not set up like i would want with options and the like, its definitely in the front of my mind :D, i just haven't said anything cause i didn't want to get the sellers hopes up


Its actually more up to the adjuster that you get on what you will receive in the event the car is a writeoff. I got a really good adjuster and he liked my old 92 Chevy truck I had. Now all my engine mods and so forth were not in his list but he just added things I really didn't have to compensate(like foglights, running boards, and anything to increase the overall value). I was going to buy the truck back anyway BTW. He managed to give me a value of $11000 for a 150000 mile, then 11 year old 92 Regular cab long box 4X4 Chevy truck. Now I am not saying you will get someone like that but it is entirely possible. Now I never saw that money for the truck ( long story) but got half of it along with other damage claims) and on top of it kept the truck as well as it still having a clear title as no one ever wrote it off( and a clean insurance record was a no fault accident anyway). I am now in the process of rebuilding it frame up. Anyways you may only get market value but some adjusters are actually car guys too. I also have a clause on my SRT that if wrecked in the first 2 years I get the full purchase price of the car back, its nice to have.
yea Ive already noticed what the adjuster can do, and my guy seems pretty surprisingly chill, like when they were setting me up for a rental, they had originally done it for a sup compact car like an aveo or something, well i called the adjuster and said that wasn't gonna fly, and without hardly any questions or time spent, Ive been driving a quad cab hemi dodge ram around for the last couple weeks :headbang: , and thats really cool what you did with your srt, I'm definitely looking into that when i get my next car

You should actually be able to state wether you want to file a claim with her insurance company or through yours(if through yours then yes they will pay you out and then go after her ins comp). If you file directly with hers your insurance company wont be involved to much, they will be there to help.
REMEMBER even if they give you a fair market value you still have the option to go after money for other things. Time off work, any injury, general compensation for her running into you..........so start putting all that stuff together.

yea, i actually never went through my company, as far as their concerned, nothings happened to the car, and since i dont have to worry about being polite to my own company, I'm gonna be going for all the stuff you pointed out, plus others i already thought of, and I'm not gonna be nice about it :monster:
Take your time, don't ever take any first offers, consult a lawyer, do your research, don't let then screw you.
will do, thanks for the help, yea I'm a car salesman by trade, so you know I'm not going for their first, second or third offers until I'm fully satisfied.

I bet they can fix it, i got rearended by a cement truck about 10 years ago in a beretta gt that did over $12,000 worth of damage and they fixed it. Wish i still had the pictures i didnt think no way possible they would fix it but they did. Dont be sad yet, think positive and good luck! :)

Actually it was morel like 15 years ago i think i had that back in 91,92..I dunno im to old to remember all the cars i had..hahah

My wife totaled my 1991 Isuzu trooper a while back. The insurance company totaled it, and then offered me like $700.00 bucks for it, and told me if I still wanted to keep it I would have to buy it back for around $400.00 (the car was still driveable. Still is, actually, but its a trail rig now) Anyway, I told them "No way, I've seen troopers on the dealers lots that are the same year going for almost $4,500.00 I wanted more." They agreed to give me $3,700.00
Just work with them, and try to get an amount you will be happy with. They have room to negotiate.

I too used to work for one of the 3 major insurance companies.

The bottom line is the other insurance company has to put you back into the same situation you were prior to the accident... They will try and screw with you no doubt... unless you have a awesome adjuster... which can happen...
definately get your receipts and get them in line you will need them to establish value... don't let them subtract depreciation... that is bull.... kinda...

show them you are organized.... have a sheet with the highest value you can find... or if they are all about the same then list all 3. then start adding all the mods you did.. kinda of a excel type document. then at the bottom you will have a price which will be the "fair" value..

If you have a mod that wasn't damaged then they may tell you to take if off the car.. but if it could be or might be damaged then you don't have to take it..

Good Luck..... Remember... be nice, but stern, and be very organized..... take notes of everything that happens.. every phone conversation.. time.. date... details... promises.... if everything goes smooth.... great.. throw it away... if not.... it will be worth it's weight in gold. especially to an attorney.
Which i am against except it is the last possible option....
cause you have to remember.. they will get at least 33%... that means they have to increase the value of your claim 33% just so you break even... sometimes they are not good for the claimant/insured. I have seen many times when people threaten an attorney... i didn't care and most adjusters don't.... in the end... the claimant or insured got the shaft... and was better off without the attorney.

Talk about mixed emotions! Once the car has been damaged that badly, it can almost never be 100% again. There will always be rattles and squeaks as well as other problems, including resale value. You almost want it to be declared totalled. I can't imagine the insurance company is going to offer you anything more than wholesale book value for your car. They really suck that way. They really don't seem to care about the people involved, it's just about charging as much as possible while paying out as little as they can.
Might be a good time to buy a beater car and then invest in a Challenger when they arrive.
